Subject to potential cancellation if the mark remains unused for a continuous period of 5 years from the filing date.

Filing oppositions, counter-oppositions, and responding to office actions is not a viable option.

REGISTRATION

Certificate of incorporation, certified and bearing an Apostille certification or legalization; or a certificate from the chamber of commerce specifying the nature of the business, also certified and bearing an Apostille certification or legalization.

A certified copy of the priority document, if a priority claim is made

Maintaining records of licenses is not mandatory but is recommended for effectiveness in dealings with third parties. These records can be officially recorded solely for registration purposes. Additionally, separate Power of Attorney (POA) documents are necessary, with one from the licensee and one from the licensor.

WHAT YOU NEED TO KNOW

EQUIVALENT SEARCH

You can search for published and granted patents using criteria such as title, abstract, inventor(s), priority information, subject matter, and patentee(s) name.OPPOSITION

60 days from grant and publication of patent

EXAMINATION

Regarding its form, novelty, inventiveness, industrial applicability, unity, and compliance.

PUBLICATION

Published in the official gazette after the grant

OPPOSITION

 60 days for any opposition.

ANNUITIES

Annually, the fee is due on the anniversary of the international filing date and should be paid after the grant. There is a grace period of six months for late payments, with an associated surcharge, during the last three months of that period.
